Deposits

All shoots require a down payment equal to 50% of the total listed price. The down payment is part of the total payment, which will be split 50/50—down payment plus the final half. The remaining balance is due on the day of the shoot before any work begins. Deposits should be paid at least a month or a week prior to the shoot date. Failure to do so may result in the cancellation of your booking.


When Should I Book?

It is recommended that clients book at least 2-3 weeks in advance, subject to availability.


Do You Travel?

Yes, a travel fee will be applied to any location over a 30-mile radius. For out-of-state travel, additional rates and fees will apply, including flight costs, gas, and mileage compensation at the current IRS mileage rate for the year.


Late to the Shoot?

We understand that things can come up, such as traffic or emergencies. We offer a 15-minute grace period after the booked time slot.


Update or Cancel?

If you need to reschedule due to tardiness, an additional 10% of the original deposit amount will be required to secure a new date. If rescheduling is due to unforeseen weather conditions, there will be no extra cost, but all fees associated with booking a location or studio will be the client’s responsibility. Distance fees will need to be paid again for all rescheduling situations.


Terms and Conditions

Copyright Ownership

In accordance with federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), Aarron Anderson retains all copyrights to any work created or produced. This includes both tangible and intangible products associated with fulfilling this Agreement. The work produced remains the sole property of Aarron Anderson Photography and may be used in the normal course of business.

International Copyright Considerations

Under the Berne Convention for the Protection of Literary and Artistic Works, copyright protection is automatically granted to photographic works created by Aarron Anderson. This protection applies internationally and grants Aarron Anderson the exclusive rights to use, reproduce, and distribute the images globally. The client agrees to adhere to these international copyright laws and recognizes that all rights to the images remain with Aarron Anderson Photography, unless explicitly stated otherwise in a written agreement.

Permitted Uses of Product(s)

Aarron Anderson grants the client a non-exclusive license to use the produced images for personal use only, provided that proper attribution is given each time the images are used. Personal use includes, but is not limited to:

  • Use on personal social media pages or profiles.
  • Inclusion in personal projects such as scrapbooks or gifts.
  • Use in personal communications, such as newsletters, emails, or holiday cards.

Indemnification

  1. The photographer is not obligated to capture any specific moment, pose, or person(s) during the shoot.
  2. If the photographer is unable to perform services due to causes beyond control, the client will indemnify the photographer for any damage, loss, or liability. However, all payments made by the client will be refunded in full.
  3. The client agrees to indemnify and hold the photographer harmless for any liability related to technological failure, including data loss.
  4. The photographer is not required to maintain copies of the photos beyond sixty (60) days after delivery.
  5. The client agrees to hold the photographer harmless for any personal injury occurring during the shoot.
  6. The photographer will present the photos in a professional manner but is not required to cater to specific aesthetic preferences of the client.

Duty of Client

The client is responsible for obtaining all necessary permissions for the photographer to operate at the shoot location. Any failure to obtain such permissions, resulting in fines or the inability to photograph the event, is not the fault or responsibility of the photographer.

Exclusive Photographer (Weddings Only)

For weddings, the client agrees that no other party may take pictures of any poses, lighting situations, or setups created by the photographer. This ensures the photographer's work is not disrupted and their rights are respected.

Model Release

The client grants Aarron Anderson Photography permission to use their likeness in any form of media for commercial purposes, advertising, and other uses. This includes the use of the client’s image on the photographer’s website and other promotional materials.
